A class action lawsuit against nursing home operator Sun-Mar Health Care Inc. has been settled for $2 million. Sun-Mar Health Care is based in Brea and operates 18 nursing homes throughout Southern California. The lawsuit, filed on behalf of 4,000 residents of Sun-Mar facilities, accused the operator of providing substandard care. “These facilities are giving out brochures about this wonderful, superlative care – one need only look at their regulatory history…and see that it’s just not true,” said Stephen Garcia, attorney for the residents. Improving Oversight According to Garcia, the facilities were chronically understaffed and undertrained. He added that the majority of the residents represented in the case are no longer alive, but the goal of the lawsuit was mainly to improve regulatory oversight. “It was primarily viewed as an opportunity to alter and change the way care was provided for people who are still in those facilities,” he said of the lawsuit. As part of the settlement, Sun-Mar agreed to random monitoring. However, the operator did not have to admit liability under the terms of the settlement.
